Win in the 9th Circuit

Posted by David Hardy · 13 September 2023 12:40 PM

In Junior Sports Magazines v. Bonta, it today struck down a California ban on on advertising firearms in ways that might be attractive to minors.

"[T]his case is about whether California can ban a truthful ad about firearms used legally by adults and minors--just because the ad "reasonably appears to be attractive to minors.""

Congrats to winner Don Kilmer and Carl Michel...

This essentially reverses the District Courth's denial of a preliminary injunction. Normally any pro-2A decision in the 9th Circuit ends up being reversed by the full 9th Circuit en banc.

Is this the kind of decision that can get a rehearing en banc, or do we have to wait for a final decision by the District Court on remand before that happens?
