Yet another victim of NJ gun laws

Posted by David Hardy · 5 June 2015 02:31 PM

Carol Brown, 39. Fatally stabbed by ex-BF while waiting to receive a gun permit. She applied in mid-April, the law says the police are supposed to decide within 30 days, but in practice they never do.

Laws are for you, not for them.

Negligent Homicide?

oldguy | June 6, 2015 6:54 AM | Reply

The reality is that it is highly dependent on where you live and whether you already have an FID or not. Not if you already have a handgun but that you already have the FID. I have one and got my pistol purchase permits (don't ask) in 9 days. I friend in another town took 40 days. A relative in a different town got the Initial FID and purchase permits in less than 30 days.

Too much discretion on the part of the police is part of the problem, the whole may issue is even bigger

I would hope it would be at least negligent homicide as oldguy says but everyone knows the chances of that due to "we have no duty to protect" and pulling the "Qualified Immunity" Card allow these absolute despots to get away with murder (literally). It is sickening.

"Qualified Immunity" is starting to look more and more like a privilege of peerage that is banned under the Titles of Nobility clause (U.S. Constitution, Article I, Section 9, Clause 8). I don't know if an exemption like this could be classified as "compensation" in legal terms, but it certainly appears to be compensating for assumed risk by an officer of the executive branch.
