I seem to remember reading some place that some one was arrested because his jacket lifted up while reaching for something on a shelf and revealed he was carrying. Sadly when they say concealed in these places they look for any excuse to punish you for carrying.
I feel no sympathy for him.
Besides not checking to see if his permit covered him in NJ, he seems to have chosen to escalate a situation by first brandishing a pistol and then taking a rifle out of his vehicle and brandishing it. NJ law http://lis.njleg.state.nj.us/cgi-bin/om_isapi.dll?clientID=525171&Depth=2&depth=2&expandheadings=on&headingswithhits=on&hitsperheading=on&infobase=statutes.nfo&record={16EC}&softpage=Doc_Frame_PG42 allows for the use of deadly force but seems a bit hazy on the threat of the use of deadly force. In other words, if you shoot someone you might be OK, but if you brandish your gun you might not.
I admit I may be wrong but it appears there were several opportunities for him to just drive away.
stay safe.
This is very similar to a situation that my late father found himself in many years ago. As he was walking through a shopping center parking lot one evening, several young men approached him and wanted his wallet. What he did instead was pull out his .38 S&W Detective Special, at which point they turned tail and ran. This was one of the hundreds of thousands of defensive uses of firearms that did not result in shots fired, let alone a dead gobbelin, as documented by Gary Kleck. Nonetheless, in New Jersey this would have constituted brandishment, proving once again that gun control laws are the crook's OSHA. Luckily my dad was in Florida.
We all should feel for this man. It is because of the Courts in the US that we have this garbage hodge-podge of laws. The freaking soopreem court in 1833 decided the Bill of Rights DID NOT bind the states even though the top law book by Rawle explained that it did. Because of the decision we have states screwing the people over Arms which the states have no legitimate authority to regulate. They may regulate things such as murder, etc but not the Arms themselves.
The 2nd applies to all governments under the supremacy clause and SHALL NOT BE INFRINGED is an absolute command, not a request. There are no holes in the 2nd that allow the states to infringe on the God-given Right.
I feel the lick is on him, before any trip I take I verify whether or not my concealed permit is recognized in the states I will visit or pass through. I see it as part of the responsibility of having the permit in the first place plus it keeps my rear end out of trouble should I be stopped.
