Thoughts on Rahimi and on Range

Josh Blackman has them, over at the Volokh Conspiracy. The government wisely chose the Rahimi case. It involves a violent goon, and the prohibited person category hardest to justify under text, history, and tradition. They want to challenge Bruen, or at least cut back on its teachings, and Rahimi was the perfect case for that.

Josh points out there is another case pending on cert (vote likely to be taken later this month), which is the converse. In the Range case, the prohibited person was such due to a conviction for welfare fraud, years ago. The Third Circuit upheld a Second Amendment as-applied challenge to the statute. If the Supreme Court grants cert, there could be an interesting interplay between the two cases.

It's time the SC simply said we screwed up in Barron and the 2nd covers all govts completely. There are no exceptions, no exclusions. If the govts want to keep someone like Rahimi from having arms, put the guy in jail. No more woke sentencing. Eliminate those who are evil once and for all. Hang them publicly and leave the bodies up there to dehydrate. Stop coddling evil but don't claim to have visions about the Constitution that make holes one can drive a semi thru to control things the govt is not supposed to control.

The Constitution IS the supreme law and if it is to remain such it must be understood by all persons WITHOUT the aid of some legal manipulations. We the People put the law down to control ALL facets of govt. No part of the govt has the legitimate authority to tell We the People what We mean.

The trouble with killing all criminals you find offensive is the small but not insignificant chance that the cops (with qualified immunity) lied or the prosecutor (with absolute immunity) lied to put that person in your gallows. Both cops and DAs are financially rewarded with finding somebody/anybody guilty. Even if the party found guilty is there due to .gov incompetence and not greed or malice, are you willing to bet your life to trusting the .gov to not stretch your neck in error?
