Here is SAF's motion for summary judgment, via attorney David Sigale. It is VERY well written.

The very first sentence of the motion has a subject/verb disagreement: "Plaintiffs . . . states". Should be "Plaintiffs state".

It will be interesting to see the reply briefs. How long do they have to file?

The error I see is in the wrong restriction of defining "bear" solely to mean carrying. When parsing the statements concerning the Right to keep and bear Arms in defense of themselves and the state, one cannot limit "bear" to mean solely to carry. Small minds, small definitions. Merely carrying does not provide defense of themselves and the state. Bear must include the use of those arms as no other term has been employed in any of the statements similar to the 2nd amendment. If not to both carry and use, then what term is missing and why did the Framers of the federal constitution and those of state constitutions not add "use", "deploy, etc to the "Right to keep and bear"?

Yeah bad guy! Get away from me 'cause I'm carrying. Don't know if I can "use" it but I CAN carry it. Duh!
