WashPo on Justice Thomas

Posted by David Hardy · 17 February 2022 02:56 PM

At the Volokh Conspiracy, WashPo is catching hades for its referring to Clarence Thomas as "the Black justice whose rulings often resemble the thinking of White conservatives."

As Josh Blackman observes,

"The Court's white conservatives issue rulings that often resemble those of Justice Thomas. Thomas is the intellectual leader of the Court's conservative wing. And he has been for decades. Gorsuch, Alito, and the rest are just trying to keep up with CT. But once again, we get the racist trope that Thomas is Scalia's clone. Just the opposite. Scalia often remarked that Thomas pushed him to the right. What lazy writing from the Post."

It's not lazy writing. It's just pushing the narrative. It's what they do, all day every day.

Prof. Sowell's "Black Rednecks and White Liberals" is relevant.

Yet I have to qualify my comment by the fact that neither "white" nor "black" is relevant; they are only (and have only ever been) superficial, homogenized, political descriptors. ...

These terms are nothing and we should condemn the use thereof.

Yet, I understand the purpose in Prof. Sowell's choice of title. ...

People with morals (not always religion; some just don't realize how religious they are) always work harder because of their struggle to avoid obvious violations of their belief systems; clearly a "two edged sword" - avoidance encourages evil. ... Confrontation (early, non vicious, non violent) is the only way to lead.

J. Clarence Thomas is a true American Hero.
