Caniglia v. Strom, decided today
Posted by David Hardy · 17 May 2021 10:31 AM
A 9-0, four-page reversal of the First Circuit, which had held that the "community care taking exception" allowed warrantless search of a home and seizure of a firearm.

Amazing.
I would have bet at least one of snivelers in black robes would have found some sliver of the shade of a penumbra to come back with "Yeah, but...".
And I agree with ER, no doubt some cop-friendly judge would have given them a warrant.
9-0 Decision. That gives me pause. Plus, it's a very strong & strongly worded decision.
Almost a good call - but the cops certainly could have applied for and received their warrant, despite there being no threat to anyone.
