If you are going to have unconstitutional police departments you may as well make as many as you can. As Jefferson pointed out in 1798, the feds were granted ONLY 5-6 police powers. And nothing has changed in the granted powers since then. Those originals were punishing counterfeiting, punishing piraces on the High Seas, punishing felonies on the High Seas, punishing offenses against the law of nations, punishing treason, and (for me) securing copyright and patent. No other police power/punishment law is legal, constitutional or otherwise allowed under the powers of the federal government. Some folks may not like it that the feds cannot constitutionally punish violations of commerce law or tax law but that's the way the Framers did it. There are no implied powers that attach through the N&P. That lie is the most egregious lie the judiciary has perpetrated on the people. It is SO SIMPLE to prove the error of those who believe in attached/implied/associated powers by superficially looking at the granted powers. If there are attached/implied/associated powers brought to bear by the N&P clause, then fully half of the actual, explicit grants are totally unnecessary. That then would mean that the Framers were too stupid to write a valid Constitution since they included so many unnecessary clauses and grants when a magical N&P clause would just bring all the needed authority. Hell they just needed the N&P clause and could have left everything else out. It would have been so much simpler and the judges today wouldn't have to dig at their crystal balls so hard to find magical results.
