Would a suit like this be subject to dismissal under the PLCAA?

It just further shows how stupid these kinds of laws are.

I can beat a shovel into an AK-47, so I guess shovels should be banned. I can make a zip gun with a nail and metal tubing from Home Depot, so I guess those are out also.

Penal Code makes it a 'wobbler' - possibly misdemeanor, possibly felony - to assemble such kits, inside CA, to a functioning large-capacity magazine; that such a problem is difficult to detect is an application issue, not a legal one.

And, we have a 2005 letter from the AG saying such kits are legal to buy: http://www.hoffmang.com/firearms/DOJ-large-cap-magazines-2005-11-10.pdf, expecially
"Q3: Can you import all the parts of a single hi-cap magazine at once, provided they are unassembled?
A3: Yes."

At last! The solution to their gang warfare problems! Once they enforce this ban, the streets will be safe!!!
