Challenge to new Connecticut laws

Posted by David Hardy · 23 May 2013 10:40 AM

Complaint, in pdf, here. The law is quite draconian. Obtaining a "great than ten round" magazine is a felony; continuing to possess one already owned is a misdemeanor on first offense, felony on second. Buying or selling an "assault rifle" is a felony, minimum of two years' imprisonment. "Assault weapon" is defined in a way that may include almost any semiauto with detachable magazine.

What is everyone's assessment of the chances of this suit?

Complaint reads very nice. Puts everything in the right perspective.

The elements of a rifle that make it an "assault rifle" under this ridiculous law are nothing more than common "safety, accuracy or ease of use features" and this complaint makes a very good argument for that.

And the section on how unconstitutionally vague this law is, is spot-on.

Very well done.

Who knows if the assigned judge will care, but at the very least this action is well plead.
