Sobering thoughts about the upcoming election

To quote the First Lady, "You’re here because you know that in just 13 months, we’re going to make a choice that will impact our lives for decades to come … let’s not forget what it meant when my husband appointed those two brilliant Supreme Court justices … let’s not forget the impact that their decisions will have on our lives for decades to come.”

And let's not forget that both Heller and McDonald were 5-4 decisions.... and that two members of the majority are now 76, and will be 80 in four years.

Of course it takes more than an election. In Heller, two of the four dissenters were Republican appointees (Stevens was appointed by Ford, and Souter by the elder Bush.

To repost a comment I made a few weeks ago at "No Lawyers - Only Guns and Money" on this thesis:

Sorry, I just don't buy it. A "right" which currently depends on the vote of a single notoriously fickle man (Justice Kennedy) or future appointed justices is no right at all.

This is also assuming that when it comes down to specifics we're going to get rulings that actually make a difference on the ground. So far not much of that has happened; if Miller II is denied cert I'm counting this experiment as over for the time being.

And if a new makeup results in a quick reversal of Heller and Miller the only thing it will harm is the prestige of and respect for the Supreme Court, which would not be an entirely bad thing. It would most certainly energize us politically, which is an area I'll note we are enjoying overwhelming victories.

I think it will be up to the Senate to protect our very fragile right. Their needs to be a litmus test on the 2nd amendment just like there is for therapeutic abortions. No justice should be confirmed who does not support our rights. This means it is not totally dependent on the presidential selection which have been notoriously bad. And also means a vigilant political battle must be won. We didn't do so well with the last 2 appointments, so we have to do better in the future.

Bush 1 screwed up bad when he appointed Souter. But he did make up for it when he appointed Clarence Thomas, one of the best members of the court.

In the past Republicans have not really done any scrutiny on justices and more or less just let them through. That was and is a problem. The Democrats fight to the mat to prevent the ones we would like.
