Virginia ruling on a "Terry" stop

Commonwealth v. Smith. In a split decision, a majority upholds a frisk based on a traffic stop where police knew that the driver had fairly recently been arrested for drug distribution and for felon-in-possession, but did not observe signs that he was then armed.

You can go thru your felony stops and your terry stops and you can always be (should be) on the alert all the time but,unfortunately, the one that gets you is the one you didn't expect...
"[A]nd dangerous" is going to be a very important concept - otherwise even all law abiding carry permit holders are going to be frisked at every stop...
