California legislator moves to ban open, unloaded, carry

Story here. CA allows carry if it's open and the firearm is unloaded, but some think that's just beyond tolerance. Brady Campaign says “They are pushing the gun culture onto the community " and a California police chief complains that officers have to check before knowing the gun is unloaded.

Is checking to know if a gun is unloaded considered a civil rights violation in CA? Do they deem it automatic probable cause?

DustyDog, it is written into CA law that LEOs can inspect for open unloaded carry. Lots of the LEOs are respectful. Some are not. The LA cops are particulary arrogant, as in, "Why are you wasting our time." We always carry recorders, and if possible, bring witnesses when we UOC.

The legislature is sufficiently left wing that this bill has a chance.

Written into law does not make it constitutional.

Though I was born in Ca., I thank God I escaped to America. If it were left to me Mexico could regain Ca. by cession. I would give it to them just to stop the shame of them being a state in my country.

If the concern is the police "wasting their time" checking to see if the weapon is unloaded it would appear a little white-out, judiciously applied, could solve it easily enough.
