Circuit court tosses NYC suit
Posted by David Hardy · 30 April 2008 10:44 AM
The 2nd Circuit has held that the NY City lawsuit must be dismissed. From the article, it sounds as if they rejected the antigun district judge, Jack Weinstein's approach that a suit based on state nuisance law wasn't covered by the Federal legislation.
Update: here's the the opinion in pdf.

It's just too bad NY City wasn't ordered to pay legal fees, too.
They should have been ordered to pay legal fees, otherwise they won, despite the ruling.
all i can think of is that scene in heat when mccauley (deniro) and sgt. drucker are just leaving alphonse after setting up a meeting, and on the way out mccauley yells back, "don't waste my m--f--ing time!"
