Ohio case on open carry

Posted by David Hardy · 5 June 2006 12:04 PM

Ohioans for Concealed Carry reports an abuse matter.

The gun owner held a CCW permit, but was carrying openly and peacefully when apparently someone reported him. Oregon, Ohio police made a felony stop--guns out, keep your hands out of the car, etc. They charged him with failure to notify police he had a CCW permit (although he states he did so, and it's not clear to me that those requirements apply when carry is open) and with violating a city ordinance that forbids ALL carry of ALL firearms.

Then for good measure, the authorities revoked his CCW permit and confiscated his firearms. Legal basis for that is not known.

The police are our friends. They uphold the Constitution. They keep freedom safe.

Actually, many are. Many are active shooting sports and RKBA activists. Whenever I read an online commando type JBT or something to the like I cringe...it's the wrong attitude.

This guy may end up compensated for the harassment and a city in OH may lose its gun control law.

Some lawyer is going to come out of this richer, possibly much richer. Unless things in OH have changed recently, open carry was fully legal when I lived there, even if few folks openly carried.

Seems the Ohio Supreme’s have created this can of worms and the lawful citizens are paying for it.

Uh, Dave, it's specifically provided for in the implicit "Because We Can" clause that's part of every law passed these days.
