« Minnesota mass killer planned to avoid armed citizens | Main | ATF official goes right to Bloomberg's antigun group »

Quite a month for the Second Amendment!

Posted by David Hardy · 1 September 2025 11:14 PM

The !0th Circuit strikes down a New Mexico "cooling off" law.

But the 4th Circuit upheld Maryland's handgun purchase permit requirement. The 4th also rejected a facial challenge to a Fairfax VA ordinance forbidding firearms in certain places, including parks.

And a Delaware trial court cited the state constitution in striking down the state's ban on possession of handguns by young adults.

On the side (I don't have a link) the government withdrew its appeal of a ruling invalidating the ATF ruling against stabilizing braces for handguns. Plus, it withdrew its appeal of a successful challenge of the ban on carrying in post offices.

I like to use Art 1 Sec 8 to demonstrate that the feds were NOT empowered to operate the postal service.

Note that the clause on post offices and post roads is to ESTABLISH. In this same section the feds are delegated power to provide and maintain a Navy.

The same folks wrote these two delegations. One would expect that if the Framers wanted the feds to provide AND maintain the post offices and roads that the language would support that.

Establish may include provide but it surely does not extend to maintenance and operation.

So those post offices should have been operated and maintained by other entities regardless of good intentions. It surely hasn't been of great benefit. I've had issue lately with mail traveling 40 mi but taking 7-10 days.

Add in Barron v Baltimore(1833) which caused all the ruckus with state level antigun laws including sensitive places and restrictions on carry. IF the SC hadn't skipped the supremacy clause, most if not all these 30,000 state level laws would never have arisen.
