Having worked for FDA 34 years I am somewhat skeptical that it was classified as a Class I medical device. If one goes to the definition of a device at 21 U.S.C. 321(h) it is hard to envision that the palm pistol meets any of those criteria. And if one goes to the FDA website and does a search in the Devices section nothing seems to turn up for the palm pistol. Of course, it could be the data hasn't been entered yet. But still, one would have to ask how the gun can be used for diagnosis or treatment of disease, or otherwise effect the structure or function of the body by other than chemical means...

It's obviously a hoax. The Palm Pistol meets the BATF's definition of an AOW. You could only buy it if you had a special license, and you couldn't carry it under any circumstances.

Dear Hanshin:

Having worked for FDA for 34 years, then you should be thoroughly familiar with 21 CFR 890.5050 "Daily Activity Assist Device" having Product code ILT. This is the justification for and basis upon which the Palm Pistol is listed as a Class I Medical Device, exempt form 510(k) Pre-Marketing Notification. The reason my company name and device do not appear within the database is because the computer system only propogates changes once per month. Do your search again in in mid-December. But then again, having been an FDA employee for 34 years, you are aware of this.

The ATF has classified the Palm Pistol as a standard "pistol" and not AOW. If you return to my website at www.palmpistol.com, you can download a link to the .pdf image of ATF's confirming letter and Steve Halbrook's memo.

You may obviously apologize to me for alledging a hoax at any time that is convenient.

Even if the ATF had classified it as an AOW, which it hasn't, there is no law against carrying AOWs at the federal level if you're in possession of the appropriate tax stamp.
