Prof. O'Shea on Heller and Scalia

Over at Concurring Opinions. Perceptive, as always.

Tommorrow we'll know, or maybe not. Seven opinions left. The Court will either announce Heller... or not, and set one more day for opinion release (probably tho not certainly Thursday).

I say they dont put it out today.. I say they Stall.... Just know , that the day it comes out it will be ALL the MEDIA talks about for DAYS.

I think the Trojan horse here is the term "Reasonable restrictions".. That is going to be A HUGE problem.... I did not see the term in the Bill of rights, however none the less this term is going to be a huge problem.

Eric S, where do you get the idea there will be doom and gloom?

How can you tell the reason the opinion is being held back is not that it will offend anti-gunners?

Let me re establish my position . I am optimistic about the ruling being in our favor. On the side of the Bill of rights. I belive we will be okay.
I do however belive the Anti-gunners have strong ties to Ruth Bader-Ginsberg and Stevens.

I belive Justice A. Scalia will do the correct thing. I just belive the dissenting opinions of Bader-Ginsberg will use the "Reasonable Restriction" Rhetoric and try to marry that to the " Living Constitution" Collective thought process. A Thought PRocess that is WRONG, but non the less I belive the Anti Freedom Left will make the wording " Reasonable Restriction" as the phrase they will use to launch an anti-gun crusade.
I Pray Justice Scalia adresses that.

No opinion today. It will be Thursday for all remaining opinions. This seems to imply that all remaining opinions will be issued. It could also mean that all opinions they intend to issue will be released Thursday. They can hold it over but it is a rare thing.
